Welcome to FacadeThemes. These Terms of Service ("Terms") are a binding agreement between you and FacadeThemes LLC ("FacadeThemes," "we," "us") governing your use of the website facadethemes.com and the products and services offered on it (together, the "Service"). By using the Service, creating an account, or making a purchase, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service Is
FacadeThemes uses artificial-intelligence systems to generate projection-mapping theme concepts and digital media assets (such as concept images, looping videos, transparent prop images, textures, audio, and production documentation) based on a photograph of a building facade and creative inputs that you provide. Purchased assets are delivered as standard digital files for use in third-party projection-mapping software. FacadeThemes does not sell, include, or license any projection-mapping software, projectors, or other hardware — those are separate products you obtain on your own from their respective vendors. FacadeThemes is an independent company and is not affiliated with, endorsed by, or sponsored by any projection-mapping software vendor.
2. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- Access is identified by a verified email address. You are responsible for the accuracy of the email you provide and for activity that occurs under it.
- We may decline, limit, or revoke access (including rate limits and anti-abuse measures) to protect the Service, prevent fraud, or stop misuse.
3. Purchases, Pricing, and Payment
- Current offerings and prices are shown on the site at the time of purchase (for example: preview-spin credits, a "Blueprint" manifest package, and a full asset package, with optional add-ons). Prices and offerings may change at any time; changes do not affect purchases already completed.
- Payments are processed by Stripe. We do not store your full card details. Your payment is also subject to Stripe's own terms and privacy policy.
- All prices are in U.S. dollars. You are responsible for any applicable taxes.
4. AI-Generated Content — Important Expectations
The Service's output is produced by generative AI. By using the Service you understand and accept that:
- Results vary. Each generation is unique; re-running the same inputs will produce different results. Preview images are artistic concepts, and the "On Your Home" view is a concept visualization — not an exact prediction of how a projected show will physically look on your property.
- Safety filters apply. Our AI providers enforce content-safety systems. Some prompts or concepts may be blocked or altered. Where a generation falls below our usability threshold, we do not charge the generation credit for that run.
- Similar outputs may exist. AI systems can produce similar content for different customers. We do not guarantee that generated assets are unique to you.
- Final quality depends on you. The real-world appearance of any projection show depends on your projector, software, masking, calibration, weather, ambient light, and skill — all outside our control.
5. Your Uploaded Content
- You keep ownership of the photographs and text you upload. You grant FacadeThemes a non-exclusive license to store, process, transmit to our AI service providers, and display that content back to you, solely to operate and improve the Service.
- You represent that you have the right to upload the content you provide — including the right to use a photograph of the property in question — and that your inputs do not violate any law or third-party right.
6. License to Purchased Assets
- Upon full payment, FacadeThemes grants you a worldwide, perpetual, non-exclusive license to use, modify, and publicly display the purchased digital assets in projection shows and related media (including photos/videos of your shows), for both personal and commercial display purposes (for example, running shows for your own home or for your clients).
- You may not resell, redistribute, or license the asset files themselves as stand-alone digital products (e.g., stock content, template packs), and you may not use the Service or its outputs to build or train a competing asset-generation product.
- Because content is AI-generated, the extent of copyright protection in generated output may vary by jurisdiction; the license above defines your rights as between you and FacadeThemes regardless.
7. Acceptable Use
You agree not to:
- Request or attempt to generate content that infringes third-party intellectual-property rights (including copyrighted characters, logos, or brands), or that is unlawful, hateful, or harassing. We screen for protected IP and may block such requests.
- Circumvent rate limits, free-credit limits, payment, or other technical controls (including by rotating email addresses).
- Scrape, reverse-engineer, probe, or disrupt the Service.
We may refuse or block any generation request, and may suspend access for violations, with no refund of amounts attributable to abuse.
8. Delivery and 14-Day Retention
- Purchased packages are delivered as downloadable files. Generated theme sets and packages remain available for re-download/reload for 14 days from creation, after which they are automatically and permanently deleted. Download and back up your files promptly.
- We are not responsible for loss of files you failed to download within the retention window, though we will try to help where we reasonably can.
9. Refunds and Cancellations
- Each package is custom-generated on demand and delivered digitally, so all sales are final once your assets have been generated.
- If something is wrong with your package (missing, corrupted, or materially defective files), contact info@facadethemes.com within 7 days of purchase and we will make it right — by regenerating the affected assets, providing a replacement, or issuing a refund at our discretion.
- Dissatisfaction with the AI's creative choices (style, composition, mood) in an otherwise complete and functional package is not a defect; the preview steps before purchase exist so you can evaluate the creative direction first.
10. Safety Disclaimer
Operating projectors and electrical equipment outdoors carries inherent risk. You are solely responsible for the safe installation and operation of your own equipment, compliance with local ordinances (including light and noise rules and any FM-transmission regulations), and obtaining any permissions needed to project onto any property. FacadeThemes supplies digital content only and has no responsibility for your physical installation or its effects.
11. Intellectual Property of the Service
The Service itself — including the site, software, branding, "FacadeThemes" name and logo, and all content we create — belongs to FacadeThemes LLC or its licensors. These Terms grant you no rights in the Service except as expressly stated.
12. Third-Party Services
The Service depends on third-party providers (including AI generation services and payment processing). We are not responsible for their availability or output, and temporary degradation of a provider may affect generation quality or speed. Names of third-party products (such as projection-mapping software) are trademarks of their respective owners and are used only to describe compatibility.
13. Disclaimers
THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACADETHEMES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold FacadeThemes LLC harmless from claims arising out of your uploaded content, your use of generated assets, your physical installations, or your violation of these Terms.
16. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms. Sections that by their nature should survive (licenses to delivered assets, disclaimers, liability limits, indemnification) survive termination.
17. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at info@facadethemes.com and give us 30 days to work it out informally — most issues are fixable.
18. Changes to These Terms
We may update these Terms from time to time. The "Effective date" above will change when we do, and continued use of the Service after an update constitutes acceptance. Material changes affecting active purchases will not apply retroactively.
